TERMS AND CONDITIONS OF SALE

1. Scope

These Terms apply to all sales concluded between Nuë and customers through the Website.

The customer declares that they are at least 18 years old or have the legal capacity to enter into a binding contract under the laws applicable in their country of residence.

2. Products

The products offered for sale are those displayed on the Website, subject to availability.

Nuë makes every effort to ensure that product descriptions, visuals, and information are as accurate as possible. However, minor variations may occur, particularly with regard to colors, packaging, or presentation, without affecting the essential characteristics of the product.

3. Prices

Shipping costs, taxes, customs duties, and any additional fees are indicated before the order is confirmed, where applicable.

Nuë reserves the right to modify its prices at any time. However, products will be invoiced on the basis of the price in force at the time the order is validated by the customer.

4. Orders

After placing an order, the customer will receive an order confirmation by email. This confirmation does not guarantee final acceptance of the order.

Nuë reserves the right to refuse, cancel, or limit any order in the event of suspected fraud, payment issues, abnormal order volume, stock unavailability, or any legitimate reason.

5.Payment

Orders must be paid in full at the time of purchase using the payment methods offered on the Website.

The order will only be processed once payment has been successfully authorized and confirmed.

Nuë reserves the right to suspend or cancel any order in the event of payment incident, non-payment, or suspected fraudulent transaction.

6. Shipping and Delivery

Estimated delivery times are provided for information purposes and may vary depending on production lead times, logistics, destination, customs, and carrier constraints.

Nuë shall not be held liable for delays attributable to the carrier, customs authorities, force majeure, or circumstances beyond its reasonable control.

8. Right of Withdrawal

If the customer is a consumer located in France or in the European Union, they may benefit from a statutory right of withdrawal in accordance with applicable law.

9. Returns and Refunds

Returns and refunds are governed exclusively by the Return & Refund Policy available on the Website.

No return will be accepted without prior written request and compliance with the return procedure set out by Nuë.

Products returned incomplete, used, opened, damaged, altered, or unsuitable for resale may be refused or may give rise to a partial refund only, where legally permitted.

10. Product Availability

Product offers are valid as long as they are visible on the Website and while stocks last.

If a product becomes unavailable after an order has been placed, Nuë will inform the customer as soon as possible and may offer a replacement, store credit, or refund.

11. Transfer of Risk

The risk of loss or damage to the products passes to the customer upon delivery to the address indicated during checkout.

It is the customer’s responsibility to check the condition of the parcel upon receipt and to report any apparent issue as soon as possible.

12. Limitation of Liability

Nuë shall not be held liable for any indirect, incidental, or consequential damages arising from the purchase or use of the products, except where liability cannot be excluded under applicable law.

Nothing in these Terms excludes or limits any mandatory legal guarantees or statutory rights granted to consumers under applicable law.

13. Intellectual Property

All elements of the Website, including but not limited to texts, visuals, branding, logos, graphics, designs, and product presentation, remain the exclusive property of Nuë or its partners.

Any reproduction, exploitation, redistribution, or use without prior written authorization is strictly prohibited.

14. Personal Data

Personal data collected in connection with orders is processed in accordance with the Privacy Policy available on the Website.

15. Force Majeure

Nuë shall not be liable for any failure or delay in the performance of its obligations caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, war, epidemics, supply chain disruption, transport interruption, or administrative restrictions.

16. Governing Law and Disputes

These Terms are governed by French law.

In the event of a dispute, the customer is encouraged to contact Nuë first in order to seek an amicable resolution.

Where required by applicable consumer law, the customer may also have access to a consumer mediation mechanism.

If no amicable solution is reached, disputes shall be submitted to the courts having jurisdiction under applicable law.
